Terms and Conditions

Welcome to Pitturino ("the Service", "the platform"). Before using the Service, please read these Terms and Conditions ("Terms") carefully. By accessing or using Pitturino you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use the Service.

2. Acceptance and Changes to the Terms

2.1. By using the Service you confirm that you are at least 16 years old or, if younger, that you have obtained parental or guardian consent.

2.2. We reserve the right to update these Terms at any time. Material changes will be communicated by email or by an in-app notice at least 14 days before they take effect. Your continued use of the Service after that period constitutes acceptance of the changes.

3. Accounts and Security

3.1. You are responsible for keeping your Account credentials confidential and for all activity that occurs under your Account.

3.2. You must notify us immediately of any unauthorized access to your Account at support@pitturino.com.

3.3. Sharing Accounts with third parties or creating multiple accounts to circumvent plan limits is not permitted.

4. Subscription Plans

4.1. Free Plan

• Limited access to the editor
• 1 saved project
• No exports included

4.2. Pro Plan

• Unlimited projects
• Up to 20 monthly exports (SVG/PDF)
• Personal, non-commercial use

4.3. Business Plan

• Unlimited projects and exports
• Commercial license included: Works may be sold, distributed or used for commercial and professional purposes
• Priority access to new features

4.4. Credits

Credits are single-use units that can be purchased to unlock additional exports without subscribing to a plan. Each consumed Credit corresponds to one export operation.

5. Payments

5.1. Prices are listed on the Pricing page and may change over time. Price changes apply to renewals after notice is given.

5.2. Subscriptions automatically renew at the end of each billing period (monthly or yearly), unless canceled before the renewal date.

5.3. Payments are processed through Stripe, which acts as an independent payment processor.

6. No-Refund Policy

⚠️ IMPORTANT: Credits and subscriptions are non-refundable.

6.1. Purchased Credits: Credits are digital goods for immediate use. Once purchased, Credits are non-refundable, whether used or unused.

6.2. Subscriptions (Pro and Business):Subscriptions are non-refundable. Upon cancellation, access to plan features remains active until the end of the already-paid billing period, with no pro-rata refunds.

6.3. Exceptions: Partial or full refunds may be considered only in cases of:

• Documented double billing due to a technical error
• Failure to provide the Service for more than 7 consecutive days for reasons attributable to us

6.4. Requests for exceptional refunds must be sent tosupport@pitturino.com within 30 days of the charge.

7. License to Use Works

7.1. Personal Use (Free and Pro Plans)

Works created under Free and Pro Plans are licensed for personal, non-commercial use only. You may not:

• Sell, distribute or sublicense Works
• Use Works to produce merchandise, prints, or paid products
• Incorporate Works into products or services offered for commercial purposes

7.2. Commercial Use (Business Plan)

The Business Plan includes a Commercial License that authorizes the User to:

• Sell and distribute Works created with Pitturino
• Use Works for professional, advertising or merchandising purposes
• Incorporate Works into physical or digital products intended for sale

7.3. Unauthorized Commercial Use and Retroactive Fees

⚠️ IMPORTANT NOTICE

7.3.1. Commercial use of Works (including sales, paid distribution, or incorporation into commercial products) is permitted only for Users with an active Business Plan at the time of the commercial use.

7.3.2. If we determine — even after the fact — that a User engaged in commercial activity using Works created with Pitturino without an active Business Plan for the relevant period, the User will be required to:

1. Regularize their status immediately by subscribing to the Business Plan;
2. Pay retroactively the Business Plan fees for each month (or portion of a month) in which the Works were commercially exploited, plus an administrative penalty equal to 50% of the amount due;
3. Cease any commercial activity with the Works until the situation is regularized.

7.3.3. Examples of admissible evidence of unauthorized commercial use include, but are not limited to: product listings, marketplace pages, sales receipts, screenshots of storefronts, and public communications.

7.3.4. Failure to pay retroactive amounts entitles us to suspend the User's Account immediately and to pursue recovery of amounts due through appropriate legal channels, including legal costs.

8. User Content and Uploaded Images

8.1. By uploading images to the platform, you represent that you own the necessary rights or have obtained the required authorization.

8.2. You must not upload images that infringe third-party rights, or that are obscene, offensive or illegal.

8.3. Pitturino does not claim ownership of uploaded images or created Works. However, you grant us a non-exclusive, royalty-free license to process the images solely for the provision of the Service.

8.4. Uploaded images and projects are stored on secure cloud infrastructure. For details, see our Privacy Policy.

9. Acceptable Use

You must not:

• Attempt to decompile, reverse-engineer, or access the Service's source code
• Use bots, scripts, or automated tools to abuse the Service
• Interfere with the platform's infrastructure or security
• Collect other users' data without consent
• Use the Service for fraudulent or illegal purposes
• Resell access to the Service or sell Credits to third parties

10. Suspension and Account Termination

10.1. We reserve the right to suspend or terminate the Account of any User who breaches these Terms, without notice and without entitlement to a refund.

10.2. You may delete your Account at any time from your profile settings. Data associated with the Account will be deleted in accordance with our Privacy Policy.

11. Service Availability and Disclaimer of Warranties

11.1. We strive to ensure high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance.

11.2. The Service is provided on an "as is" and "as available" basis, without express or implied warranties of fitness for a particular purpose.

12. Limitation of Liability

To the extent permitted by applicable law, our aggregate liability to the User will not exceed the total amount paid by the User for the Service in the 12 months preceding the event that gave rise to the damage.

We are not liable for indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Service.
